Ballot Measures Nov. 3, 2026
The following information is based on my experience as your state senator, having debated these issues when the state legislature referred them to the ballot. I've added other sources frequently so you can also follow links to do your research.
My basic recommendation:
- sensible reforms to the ESA Universal Voucher Program.
- (A couple of them are not terrible, but none of them were vetted well.)
Most of them were passed with only Republican votes, and I encourage you to vote, "No" on any issue that has support only from one political party, primarily because the words on the page have not been vetted well and that means it's likely to have many unintended consequences.
HCR2040 was written so badly, the courts ruled it must NOT be on the ballot:
HCR2040 was passed with only Republican yes votes, and was designed to end unions in Arizona. Remember that in Arizona, by law, nobody is required to join a union. All Democrats voted, "No." I certainly voted, "No" because I respect the US Constitutional right to assemble and Arizonans' right to choose a union. In July, the courts threw it OFF the ballot because it violates the AZ Constitution's rule that an amendment to the Constitution must cover only 1 topic. The Republican Leadership argued in court that the bill applied only to teachers' unions, but the judge pretty much told them to pound sand. Read the AZ Mirror explanation click here.

Trucks' and Cars' Mileage is a Secret: Any kind of fee or tax on miles driven by a vehicle would be banned. We need good, fair solutions to repair and maintain our roads, but this idea is a ROADBLOCK, not a solution. The biggest causes of road damage are weight and miles driven. Heavy trucks should be taxed appropriately, and this would block that and other options to make paying for roads more fair. |

Republicans Show they are anti-DEI Because They are Really Angry about Women and Minorities ever Getting Good Jobs: ***This "anti-DEI" prop will make racism and discrimination worse. *** Arizona already bans Affirmative Action; state government is banned from using hiring quotas of a particular group -per the AZ Constitution currently. THIS PROP would also ban using state resources even to Recruit Diverse People to Apply for public jobs. DEI is good for Arizona because diversity is strength, providing a more full spectrum of skills and perspectives. |

Food Tax: There are no cities or towns with a food tax more than 2% now. 2% would be the max if this passes. This is Republican lawmakers' feeble attempt to say that sometimes they cut taxes for the middle class and lower income folks. Baloney! Republicans cut taxes enormously time and again for billionaires and big corporations. Nothing will change if this Prop is passed. So, if you like the permanent cap of 2%, you can vote yes. If Local Control is important to you, vote no. |

**UNCONSTITUTIONAL on many grounds. Declare Drug Cartels are Terrorists, but refugees from them do not get asylum. The Republican-controlled Rules Committee should have stopped it for violating the US Constitution Supremacy Clause and for its vague wording. It will cost AZ taxpayers for many lawsuits that will ensue. Further, it requires the AZ Dept of Homeland Security to "DO EVERYTHING WITHIN ITS AUTHORITY TO ADDRESS THE THREAT POSED BY DRUG CARTELS" -- which means it would have to direct all resources to prosecuting them, and ignore all other threats. (Dear Republican lawmakers, Please work with intelligence on security threats, and stop running about like Chicken Little.) |

Bathroom Police: Transgender men with beards would be forced to use women's bathrooms in schools with this really stupid bill. It bans transgender girls from joining girls' sports teams, and bans everybody from using the school restroom they choose. The worst of this bill (And there are a lot of bad parts to it) is that it tells not only transgender people that Republicans are prejudiced about them, but also this bill tells ALL GIRLS that they are LESS than boys. Honestly, this bill is repulsive to me. NOTE: The AIA (school sports association) currently considers every case of a transgender student who wants to play on the girls' team. Sometimes they allow it, and sometimes not. That system works, and it happens only rarely. |

Photo Radar Red Light Ban: It would require a city or county to hold an election for voters to approve using a Photo Radar System to enforce stopping at red lights and speeding. The state would be banned from it unless a state agency has a contract for it by Dec 31, 2026. #1 Reason to vote No: Photo Radar "is a proven tool to save lives." -- The National Safety Council and Triple A testified with a long list of statistics to show Photo Radar is about Safety. |

Cut ANOTHER $1.2 Billion from public schools! NO! It would take away the Classroom Site Fund money from school districts that do not spend at least 60% of operational funds on teachers. This cut is IN ADDITION to the $1 billion going to ESA vouchers, it's not the same billion dollars. This prop is designed to Hurt Public School Students, in the Republicans' never-ending pursuit of destroying all public schools. Private and for-profit schools spend however they want, and Republicans give them oodles of dollars via ESA vouchers and STO vouchers, with no accountability to parents or to taxpayers. Republican extremist lawmakers want all the education tax dollars to go to private schools where they can make profits. They cannot personally profit from funding to public schools. So they are doing all they can to De-Fund public schools. Please vote NO, and tell all your friends that this is an evil prop that will harm public school STUDENTS. |
